A ‘VOLATILE’ pubgoer who was on his first night out since turning 18 grabbed a bouncer ‘in an intimate manner’ as he was being restrained.
Dalton Charleton, 18, was seen kicking a car outside Joe Bananas pub in Whitehaven at 3am on March 1, Workington Magistrates’ Court heard.
Pamela Fee, prosecuting, said one of the staff members informed one of the door staff that someone was kicking their car.
The doorman went round to see what was happening. A car alarm was going off. The doorman saw the defendant kick the back of a staff member’s car.
The doorman put Charleton to the floor. A member of the public was trying to get the defendant away and there was a ‘push and shove’.
The victim said Charleton then walked towards him with his hand up as if he was going to slap him.
As door staff restrained Charleton, he grabbed the doorman by the testicles and ‘squeezed hard’. The doorman reported he later felt ‘a gripping pain’.
In a statement, the victim said Charleton wanted to get out of being restrained and had grabbed the victim’s ‘most sensitive part’.
The victim said ‘no one wants to be restrained’ and door staff ‘only do it when necessary’. He said the defendant was ‘quite volatile’.
During police interview, Charleton was asked why he was kicking the car and why he had grabbed the victim in an intimate manner. He remained silent throughout.
Charleton, of Ashness Close, Whitehaven, pleaded guilty to assault by beating.
Mike Pope, defending, said: “It’s a guilty plea at the first opportunity. He can’t remember a thing about it.
“He had been having a good night. It was his first time out since turning 18. He went out and had a good night and clearly overindulged.
“There was clearly no sexual intent. He was attempting to get out of the clutches of the person who restrained him.
“He has social difficulties – loud noises and large groups. It doesn’t excuse his reaction to the behaviour.”
Charleton was fined £120 and ordered to pay £85 costs and a £253 victim surcharge.
